Seller Terms & Conditions
Standard platform terms for all sellers on DME Buy and Sell. By listing on our platform, you agree to the following.

1. Seller Eligibility
To list on DME Buy and Sell, you must be at least 18 years of age and a legal resident or registered business entity in the United States. You must provide accurate seller information during registration. DME Buy and Sell reserves the right to suspend or terminate accounts that provide false information.
2. Listing Requirements
All listings must accurately describe the item's condition, age, and any known defects. Sellers must upload clear images of the actual item being sold. Listings must comply with all applicable federal, state, and local laws governing the sale of medical and mobility equipment. Items recalled by the manufacturer or federal agencies may not be listed.
3. Pricing & Fees
Sellers set their own prices. DME Buy and Sell charges a platform transaction fee on completed sales. Fees are disclosed in your seller dashboard. Pricing must reflect the true sale price — no hidden fees may be added to buyers post-sale without prior disclosure in the listing.
4. Shipping & Fulfillment
Sellers are responsible for packing, shipping, and delivering items within the timeframe stated in the listing. If a listing indicates "Buyer Pickup," the seller must accommodate a reasonable pickup schedule. Sellers must provide tracking information for all shipped orders.
5. Returns & Refunds
Each seller may set their own return policy, which must be clearly stated in the listing. At minimum, sellers must accept returns for items that are significantly not as described. Disputes are resolved through the DME Buy and Sell resolution process. Sellers agree to cooperate with all legitimate dispute resolutions.
6. Equipment Safety & Compliance
Sellers warrant that all listed equipment is safe for its intended purpose and complies with applicable medical device regulations. Items must be properly cleaned and sanitized. Sellers must disclose any modifications made to the equipment. Listing equipment that poses a health or safety risk is strictly prohibited.
7. Prohibited Items
The following may not be listed: prescription-only devices without proper licensing, recalled products, counterfeit goods, items obtained illegally, and any device banned from resale by federal or state law. DME Buy and Sell reserves the right to remove any listing at its discretion.
8. Intellectual Property
Sellers may only upload images and content they own or have rights to use. By submitting content to DME Buy and Sell, you grant us a non-exclusive, royalty-free license to use, display, and distribute your listing content for platform purposes.
9. Taxes
Sellers are solely responsible for reporting and paying applicable taxes on their sales. DME Buy and Sell does not collect sales tax on behalf of individual sellers unless required by law. Consult a tax professional for guidance on your obligations.
10. Account Suspension & Termination
DME Buy and Sell may suspend or terminate seller accounts for violations of these terms, repeated negative buyer feedback, fraudulent activity, or failure to fulfill orders. Sellers will be notified of suspensions where possible. Balances owed to sellers at time of termination will be handled per our payout policy.
11. Limitation of Liability
DME Buy and Sell is a marketplace platform facilitating transactions between buyers and sellers. We are not liable for the quality, safety, legality, or fitness of listed items. Our maximum liability to any seller shall not exceed fees paid during the 90 days preceding any claim.
12. Amendments
DME Buy and Sell reserves the right to update these Seller Terms at any time. Sellers will be notified of material changes via email or platform notification. Continued use of the platform after changes take effect constitutes acceptance of the updated terms.
